You will not be able to register as the client or expert at Mypsychicadvice until you agree to be bound by this service agreement. When you are agree to be bound by this term of use and agreement you would be bound in the same way as any paper contracts bind you by such agreement.

represents that he/she is at least 18 years of age and of legal age in Host's jurisdiction (21
years where required under applicable law).
MYPSYCHICADVICE has adopted and implemented a policy that by registering as a Member (Expert or Client) and agreeing to the terms and conditions of this Agreement, and you automatically agree to the terms of the mypsychicadvice.com, Privacy & disclaimer Policies, which is incorporated into this Agreement.
MYPSYCHICADVICE has adopted and implemented a policy that Mypsychicadvice! Services is provided "AS-IS" and that mypychicadvice! assumes no responsibility for the timeliness, deletion, miss-delivery or failure to store any user communications or personalization settings. You further agree that you are responsible for obtaining access to the services, and that access may involve third-party fees (such as Internet service provider or airtime charges). You further agree that you are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the mypsychicadvice services.
The Services and Definition of Service
a. Advertising Services
MYPSYCHICADVICE has adopted and implemented a policy that mypsychicadvice.com may in its complete discretion in
1 Advertise the services of Experts offered generally via the Site and on other third party sites.
2. The way of promoting the Expert on the Site, including, without limitation, the location of the Expert within the Directory and listing on the Site.
3 The manner of representation of the Expert on the Site and the ranking of the Expert in rankings.
4. Advertise particularly your services in affiliates of mypsychicadvice.com
b. Definition of expert service:
1. You agree that Mypsychicadvice makes no representation or warranty whatsoever as to the willingness or ability of Members or clients to pay for any advice given by the Expert.
2. MYPSYCHICADVICE has adopted and implemented a policy that you can register only in one account. Multiple accounts as expert are not allowed. You have to provide certain documents like copy of your photo identification card and income-tax papers for proving your identity and receiving payments.
Using the Communications mypsychicadvice.com disclaims any and all liability in the event of the disruption or malfunction of the Communications Services. In all circumstances host's only remedy in such a case is to cease Services. Members should read experts profile carefully and select the one expert at one time and also the suitable predefined payment method for each type of service which is having validity for certain period that can use this service for that particular expert for predefined minutes. MYPSYCHICADVICE has adopted and implemented a policy that no method to get refund but in case of technical malfunction.
Mypsychicadvice.com will enable a Member to pay for services provided by such Experts. In all circumstances Mypsychicadvice.com makes no representation or warranty whatsoever as to (a) the willingness or ability of any Expert to give service or advice, (b) In all circumstances whether the Member shall find the service or advice given by an Expert is satisfactory, (c) whether the service or advice of the Expert will provide an adequate solution to his or her question, or (d) whether the Expert advice will otherwise be suitable to member’s needs.
MYPSYCHICADVICE has adopted and implemented a policy that mypsychicadvice.com does not verify the skills, degrees, qualifications, credentials or background of any Experts. Therefore member is encouraged to independently verify the skills, degrees, qualifications, credentials and background of those Experts from whom he or she receives or contemplates to receive advice or services.
FOR CLIENTS OR MEMBERS:
1-THE MEMBER OR CLIENT RELATIONSHIP (AS WITH ALL OTHER EXPERTS) IS STRICTLY WITH OWN DECISION.
2-THE MYPSYCHICADVICE.COM IS NOT INVOLVED IN ANY WAY WITH THE SUBSTANCE OF THAT RELATIONSHIP OR THE ADVICE OR INFORMATION GIVEN THEREIN, AND IN ALL CIRCUMSTANCES DOES NOT ATHORIZE AND VALIDATES THE INFORMATION OR ADVICE PROVIDED TO YOU BY SUCH EXPERT.
3-THE ADVICE OR INFORMATION PROVIDED BY EXPERTS IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND CANNOT BE CONSIDERED A SUBSTITUTE FOR YOUR OWN DECISION. EXPERT’S ADVICE SHOULD NOT TAKEN AS GRANTED AND APPROVED.
UNDER NO CIRCUMSTANCES MEMBERS SHOULD RELY SOLELY ON ADVICE PROVIDED BY EXPERTS ON THE SITE.
4- IN ALL CIRCUMSTANCES MYPSYCHICADVICE STRONGLY RECOMMENDS THAT A MEMBER SEEKING LOVE, RELATIONSHIP, HEALTH OR OTHER IMPORTANT ADVICE MAKE AN APPOINTMENT FOR AN EXAMINATION IN PERSON WITH QUALIFIED PROFESSIONALS.MYPSYCHICADVICE DOES NOT SUBMIT, REFER, SUPPORT, ENDORSE, RECOMMEND, VERIFY, EVALUATE OR GUARANTEE ANY ADVICE, INFORMATION, OR OTHER SERVICES PROVIDED BY EXPERTS, AND NOTHING SHALL BE CONSIDERED AS A REFERRAL, ENDORSEMENT, RECOMMENDATION OR GUARANTEE OF ANY EXPERT.
5- UNDER NO CIRCUMSTANCES MYPSYCHICADVICE WARRANTS THE POWER, VALIDITY, ACCURACY, COMPLETENESS, SAFETY, LEGALITY, QUALITY, EXCELLENCE OR APPLICABILITY OF THE CONTENT OR
ANYTHING SAID OR WRITTEN BY ITS HOSTS / EXPERTS OR ANY ADVICE PROVIDED, INCLUDING ANY INFORMATION CONTAINED IN ANY EXPERT LISTING.
6- UNDER NO CIRCUMSTANCES MYPSYCHICADVICE WILL BE LIABLE FOR ANY DAMAGES SUSTAINED DUE TO TRUST AND RELIANCE BY MEMBER ON SUCH INFORMATION OR ADVICE PROVIDED BY ANY EXPERT.
THIS IS A SITE FOR ENTERTAINMENT PURPOSE ONLY. PSYCHIC READINGS ARE NEVER BEEN SCIENTIFIC PROVED BUT IT SHOULD BE CONSIDERED AS AN OPINION EXPRESSED IN EXPERT’S OWN VIEWS OR ANALYSIS BASED ON HIS/HER EXPERIENCES FROM YOUR INPUTS.
Member must acknowledge that no Experts are employees or agents of mypsychicadvice.com and mypsychicadvice.com assumes no responsibility for any act or omission of any such Expert. Mypsychicadvice.com cannot predict or assess the competence of, or appropriateness for Member’s needs, of the Expert. Member must understand that Member takes full liability and responsibility for the decision to access Expert through the Site and to continue to interact with expert, and that the role of mypsychicadvice.com is firmly and strictly limited to providing access to such Experts and their services for Member’s consideration.
Member hereby relieves and agrees to hold risk-free and harmless mypsychicadvice.com, its directors, officers, experts, employees, agents, successors, advisors, consultants, and assigns from any and all causes of action and claims of any nature resulting from the acts of Experts accessed through the Site.

1- MYPSYCHICADVICE HAS ADOPTED AND IMPLEMENTED A POLICY THAT THE EXPERT OR HOST ACKNOWLEDGES AND AGREES THAT MYPSYCHICADVICE.COM IS BEING PROVIDED FOR USE AS IS, AND THEREFORE EXPERT WILL NOT HAVE ANY PLEA, CLAIM OR DEMAND VIS-A-VIS MYPSYCHICADVICE WITH RESPECT TO MYPSYCHICADVICE.COM'S MEMBERS, PROPERTIES, LIMITATIONS OR COMPATIBILITY WITH THE EXPERT'S NEEDS.
2- THE USE OF MYPSYCHICADVICE.COM IS ACCORDINGLY BEING MADE AT THE EXPERT'S SOLE AND ENTIRE RISK, WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, SECURITY OR ACCURACY.
3- MYPSYCHICADVICE HAS ADOPTED AND IMPLEMENTED A POLICY THAT MYPSYCHICADVICE EXPRESSLY DISCLAIMS ALL WARRANTIES FOR INFORMATION POSTED OR TRANSMITTED BY ITS MEMBERS. IF AN EXPERT DECIDES TO PROVIDE EXPERT'S SERVICES THROUGH THE USE OF MYPSYCHICADVICE.COM, EXPERT MUST EXERCISE A REASONABLE STANDARD OF CARE, AT LEAST THE SAME AS EXPERT WOULD IN A SIMILAR TRANSACTION NOT CONDUCTED THROUGH THE INTERNET, OR THE STANDARD OF CARE MANDATED BY HIS OR HER PROFESSION, WHICHEVER IS HIGHER.
4- MYPSYCHICADVICE HAS ADOPTED AND IMPLEMENTED A POLICY THAT
THE EXPERT SHALL NOT HAVE ANY PLEA, CLAIM OR DEMAND AGAINST
MYPSYCHICADVICE, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS,
SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS IN RESPECT OF ANY SERVICES
EXPERT DECIDES TO PROVIDE IN CONNECTION WITH THE USE OF MYPSYCHICADVICE.COM.
MYPSYCHICADVICE WILL NOT BE DEEMED THE PROVIDER OR RECIPIENT OF ANY SERVICES
ACQUIRED THROUGH MYPSYCHICADVICE.COM. THE
5- UNDER NO CIRCUMSTANCES MYPSYCHICADVICE, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS, CLINETS, MEMBERS AND AGENTS WILL BE LIABLE TO ANY EXPERT FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF BUSINESS, REVENUE, PROFITS, USE, DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT ARISES, WHETHER IN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ARISING FROM THE SERVICES OR ANY PROVISION OF THIS AGREEMENT.
6- MYPSYCHICADVICE HAS ADOPTED AND IMPLEMENTED A POLICY THAT
EXPERT ACKNOWLEDGES AND AGREES THAT MYPSYCHICADVICE DISCLAIMS ANY LIABILITY WITH RESPECT TO ANY CLAIM, SUIT OR ACTION BROUGHT BY A CLIENT OR MEMBER IN CONNECTION WITH PROVISION OF ANY SERVICES BY EXPERT OR HOST (WHICH INCLUDES WITHOUT LIMITATION, REPRESENTATIONS BY THE EXPERT AS TO EXPERT'S QUALIFICATIONS AND ADVICE PROVIDED BY THE EXPERT) THROUGH THE MYPSYCHICADVICE SERVICE AND EXPERT AGREES TO INDEMNIFY AND YOU FURTHER AGREE MYPSYCHICADVICE HARMLESS IN CONNECTION WITH ANY SUCH CLAIM AND ANY DAMAGES OR EXPENSES ARISING THEREFROM. MYPSYCHICADVICE WILL NOT BE LIABLE FOR ENFORCING ANY AGREEMENT THAT WAS MADE BETWEEN AN EXPERT AND A MEMBER, INCLUDING EXPERT FEE AGREEMENT. EXPERT WILL BE SOLELY RESPONSIBLE FOR ANY AGREEMENT MADE WITH A MEMBER.
7- EXPERT OR HOST FURTHER ACKNOWLEDGES THAT EXPERT WILL SOLELY BE RESPONSIBLE AND LIABLE FOR ANY DAMAGES TO ANY CLIENT OR MEMBER TO WHOM EXPERT PROVIDES SERVICES OR CONTETNTS.
MYPSYCHICADVICE HAS ADOPTED AND IMPLEMENTED A POLICY THAT
THAT IF MEMBER SUFFERS DAMAGES ARISING FROM OR CONNECTED TO SUCH SERVICES. IN THE EVENT OF A DISPUTE REGARDING ANY TRANSACTION CONDUCTED THROUGH MYPSYCHICADVICE.COM, EXPERT HEREBY RELEASES MYPSYCHICADVICE AND ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS FROM ALL MANNER OF ACTIONS, CLAIMS OR DEMANDS AND FROM ANY AND ALL LOSSES (DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL), DAMAGES, COSTS OR EXPENSES, INCLUDING, WITHOUT LIMITATION, COURT COSTS AND ATTORNEYS' FEES, WHICH EXPERT MAY HAVE AGAINST ONE OR MORE OF THE ABOVE.
8-YOU WILL PROVIDE INFORMATION AND ADVICE ONLY ABOUT NON-EMERGENCY MATTERS. FOR EMERGENCY MATTERS YOU WILL INSTRUCT THE MEMBER TO IMMEDIATELY CALL 911 OR 108 OR THEIR LOCAL EMERGENCY ASSISTANCE NUMBER.

1- MYPSYCHICADVICE has adopted and implemented a policy that advices and opinions of Experts are solely their opinions, and not those of mypsychicadvice.com. Mypsychicadvice.com does not assume any liability or responsibility for the accuracy of the content on the Site, including the biographical information, qualifications, credentials or other data regarding the Experts.
2- Mypsychicadvice.com does not assume any liability or responsibility for damage or injury to persons or property arising from the use of any information or advice given by an Expert.
3- If member is not satisfied with expert only remedy is to stop the service.
4- MYPSYCHICADVICE has adopted and implemented a policy that member should independently verify the qualifications, experience and credentials of any Expert engaged by Member.
5- Information/content provided by Expert via the Communications Services is determined in the Expert or host's absolute carefulness and discretion. Mypsychicadvice.com shall not (and cannot reasonably) control the information/content communicated by you via the Communications Services. You further agree that
You are responsible and legally liable for the information/content provided by all participants as a general matter by you via the Chat and communications Systems.
6- You further agree that members and experts undertakes that all information/content provided via the Chat and communications Services shall satisfy the local laws and regulations applicable to the Expert and to the Guest(s) including in the EU and the United States and other countries.
7- You further agree that members and experts shall possess all necessary intellectual property rights, interests, and licenses necessary to allow him/her to present the information/content presented by the Expert via the Chat and communications Services. Members should give true information to get right reading because false information can lead for wrong readings which can not be justified later on like testing of experts abilities and scam to harass the expert will not be encouraged on this site.
8. The following constitutes 'Forbidden Content': defamatory, abusive, obscene, threatening, racially offensive, or illegal material. You further agree that
If Mypsychicadvice.com suspects that Expert has provided Forbidden Content via the Chat and communications services, Host's account will be frozen immediately for further investigation and the Host faces permanent termination, cancellation and forfeiture of all credits from mypsychicadvice.com.
9. You have no obligation and compulsion mypsychicadvice.com or anyone else to perform as the Host or Expert and also to accept a Guests' requests. You further agree that Clients or Members also have no obligation to use this website and service if they are not satisfied with initial trail.
10. Mypsychicadvice.com may contain content, including financial information, provided by third parties. You further agree that such content is provided for informational purposes only and is not intended for trade or investment purposes. As noted above, mypsychicadvice.com does not warrant the validity, accuracy, or availability of the content and Expert advice provided and it will not be liable for any damages sustained by Member due to reliance on such information or advice.
11. You further agree that the information furnished by Experts is intended for general reference purpose only. The consultation with Experts via mypsychicadvice.com cannot and does not replace a meeting with a professional. Member is encouraged to verify the information furnished by Experts. Any information on mypsychicadvice.com and information furnished by Experts is not intended to offer a solution to a specific problem and must be considered as fairly general in nature. ANY RELIANCE ON SUCH INFORMATION IS DONE AT THE MEMBER`S FULL AND SOLE LIABILITY.

(VI) IN ALL CIRCUMSTANCES THE USE OF THIS SITE IS AT THE MEMBER`S SOLE RISK. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY OR ACCURACY. IN ALL CIRCUMSTANCES THE MEMBER SHALL NOT HAVE ANY CLAIM OR DEMAND VIS-A-VIS MYPSYCHICADVICE, ITS AFFILIATES, AND THEIR RESPECTIVE EXPERTS, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, and SUB-CONTRACTORS AND AGENTS IN RESPECT TO ANY SERVICE OR ADVICE MEMBER DECIDES TO RECEIVE AND/OR TO RELY ON. YOU FURTHER AGREE THAT WE WILL NOT BE DEEMED THE PROVIDER OR RECIPIENT OF ANY SERVICES OR INFORMATION ACQUIRED THROUGH MYPSYCHICADVICE. IN ALL CIRCUMSTANCES THE PURCHASE OF SERVICES IS EFFECTED AT THE MEMBER`S SOLE RISK. UNDER NO CIRCUMSTANCES WILL THE SITE, ITS AFFILIATES, AND THEIR RESPECTIVE EXPERTS, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS BE LIABLE TO ANY MEMBER FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF BUSINESS, REVENUE, PROFITS, USE, DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT ARISES, WHETHER IN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ARISING FROM THE SERVICES OR ANY PROVISION OF THIS AGREEMENT. THE SITE, ITS AFFILIATES, THEIR RESPECTIVE EXPERTS,OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS’ AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING WITH RESPECT TO THIS AGREEMENT WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY MEMBER TO EXPERTS THROUGH MYPSYCHICADVICE.COM IN THE SIX MONTHS PERIOD PRIOR TO THE DATE THE CLAIM AROSE. IN ALL CIRCUMSTANCES
MEMBER ACKNOWLEDGES AND AGREES THAT MYPSYCHICADVICE.COM DISCLAIMS ANY LIABILITY WITH RESPECT TO ANY CLAIM, SUIT OR ACTION BROUGHT BY AN EXPERT IN CONNECTION WITH PAYMENT FOR SERVICES BY THE MEMBER AND MEMBER AGREES TO INDEMNIFY AND HOLD MYPSYCHICADVICE HARMLESS IN CONNECTION WITH ANY SUCH CLAIM. IN ALL CIRCUMSTANCES MYPSYCHICADVICE WILL NOT BE LIABLE FOR ENFORCING ANY AGREEMENT THAT WAS MADE BETWEEN AN HOST OR EXPERT AND A CLIENT OR MEMBER, INCLUDING A MEMBER FEE AGREEMENT. MEMBER WILL BE SOLELY RESPONSIBLE FOR ANY AGREEMENT MADE WITH AN EXPERT.IN THE EVENT OF A DISPUTE REGARDING ANY TRANSACTION CONDUCTED THROUGH MYPSYCHICADVICE, IN ALL CIRCUMSTANCES THE MEMBER HEREBY RELIEVES MYPSYCHICADVICE, ITS AFFILIATES, THEIR RESPECTIVE EXPERTS,OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS FROM ALL MANNER OF ACTIONS, CLAIMS OR DEMANDS AND FROM ANY AND ALL LOSSES (DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL), DAMAGES, COSTS OR EXPENSES, INCLUDING, WITHOUT LIMITATION, COURT COSTS AND ATTORNEYS` FEES, WHICH MEMBER MAY HAVE AGAINST ONE OR MORE OF THE ABOVE. IN NO EVENT WILL MYPSYCHICADVICE OR OUR SUBSIDIARIES OR SUPPLIERS OR OUR/OUR SUBSIDIARIES'/SUPPLIERS' EXPERTS,OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, REPRESENTATIVES, LICENSORS, SUCCESSORS OR ASSIGNS, BE LIABLE TO YOU OR TO ANY THIRD PARTY WHATSOEVER FOR ANY DAMAGE, INCLUDING, BUT NOT LIMITED TO, INDIRECT, DIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, OR LOSS, OR VANDALISM OR THEFT OF PROGRAMS OR INFORMATION, AND ANY OTHER KIND OF DAMAGE), OR ANY OTHER DAMAGES ARISING IN CONNECTION WITH OR IN ANY WAY OUT OF THE AVAILABILITY OR USE OF, RELIANCE ON, OR INABILITY TO USE, THE SERVICES, THE SITE EVEN IF MYPSYCHICADVICE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, AND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT, EQUITY OR OTHERWISE. IN ALL CIRCUMSTANCES IF YOU ARE DISSATISFIED WITH THE SERVICES, THE SITE OR YOU HAVE ANY DISPUTE WITH US IN CONNECTION WITH THE SAME OR THESE TERMS OF USE THEN YOU’RE SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICES AND THE SITE.
Member: Fees
Clients can deposit money in their mypsychicadvice accounts without any service charges. The paid session will continue till money deposited in your Mypsychicadvice account equals client’s purchased minutes; it is an easy way to keep track of your budget and plan for future sessions and instant credit approval.
Expert and Mypsychicadvice Fees
It's important to note that with Mypsychicadvice there are ‘no hidden costs’ or service charges to clients. Client always pays to selected expert according to expert's by-the-minute rate, multiplied by the exact amount of time you've interacted after clicking the 'hire' button.
Mypsychicadvice's commission (the "Mypsychicadvice
Commission") will be 43% for sessions of any amounts received or earned by
the Expert, including fees, commissions or otherwise (the "Expert Fees').
Expert is not paying any connection fee or service charges to mypsychicadvice.
Mypsychicadvice reserves the right to revise the Mypsychicadvice Fees at any time without prior notice. Mypsychicadvice will rely on third party like Paypal.com to process the Member's credit card for the amount agreed upon between Members and Expert within ten (7-10) working days from the execution date of each transaction.
The Mypsychicadvice Commission will be deducted from any Expert Fees or other payment that will be received by Mypsychicadvice and credited to the Expert's account immediately upon receipt of such payment. MYPSYCHICADVICE has adopted and implemented a policy that within thirty (30) days following the end of each month, Mypsychicadvice will disburse payment to Expert as follows: the Expert Fees actually received by Mypsychicadvice in the prior month less the applicable Mypsychicadvice Commission and applicable tax or withholding taxes (if any). If the payment to Expert for any given month would be less than $50, however, Mypsychicadvice may hold such payment to Expert until the amount due is equal to or exceeds $50. Mypsychicadvice shall send the Expert payment via PayPal.
For verification of address and identity the first payment will process through check and the site can hold further payments unless the check gets cleared in expert’s account. Expert alone is responsible for reporting and paying any applicable tax or tariffs levied on him in connection with fees receivable or received due to Expert's participation in Mypsychicadvice.com.
We can deduct at source if it is
applicable under tax law in India (TDS- Tax deduction at
source).Notwithstanding the foregoing, Expert authorizes Mypsychicadvice to
withhold, in its discretion, payments to Expert of certain amounts paid by
Members by credit card until adequate time has passed to ensure that the
payment will not be disputed by the paying Member or charged back by such
Member's credit card issuer, or, if Mypsychicadvice reasonably believes that
fraudulent activity may have occurred in connection with payment, until
Mypsychicadvice is able to verify that no such activity has occurred.
Suspended
earnings are payments for completed chat sessions that have not been added to
expert’s pending earnings, it can happen when our Security Department had a
problem verifying the billing information provided by the client. You
further agree that our team will handle the
investigation of suspended earnings with top priority. Provided that the
verification process is successfully completed and that the client has paid for
all sessions conducted, the suspended amount will be added to your pending
earnings.
Cancelled earnings are payments for completed chat sessions that will not be added to expert’s pending earnings. A cancelled payment means that the client has disputed the charge in question. Although our Security Department has pursued the matter, they have been unable to reverse the disputed charge or to contact the client.
Uncharged earning or sessions are sessions that our
Billing Department experienced difficulties charging the client for and
therefore were not added to your Pending earnings. You further agree
that some sessions may temporarily appear
Uncharged. Please allow 2 days for these sessions to appear as Pending. You
further agree that we cannot guarantee the
successful processing of the client's card. Once we are able to charge the
client's card, the earnings for these sessions will be transferred to your Pending
earnings.
You further agree that Mypsychicadvice's billing system is not error-free, and Mypsychicadvice shall not be liable for any problems, miscalculations or malfunctions in processing Expert Fees or other payments due to the Expert. If the Expert thinks that a mistake has occurred he or she must send his/her complaint to support@mypsychicadvice.com within 30 days of discovery of such mistake. If for any reason the Member has not paid the Expert Fee or has paid but has later charged back such payment, no Expert Fees will be paid to the Expert for that transaction and if the money has already been sent to the Expert, You further agree that expert is required to return this amount to Mypsychicadvice, and Mypsychicadvice has the right to deduct this amount from the Expert's account or from the following payments to be made from Mypsychicadvice to Expert. For Experts who simultaneously participate as Members, Mypsychicadvice shall be entitled to transfer or set-off payments from an Expert's pending earnings against such Expert's outstanding balance as a Member
PAYMENTS TO HOSTS
Every chat is timed and priced according to the billing rate and terms specified in the relevant Expert Income Sources sections below. It is hereby clarified that mypsychicadvice.com may, at its own discretion and at any time, change these billing rates and you further agree that expert shall be entitled for payments according to the then new billing rates. It is the Host's sole responsibility to keep him informed and updated on all of the Site's terms and conditions as well as all other billing and payment issues, as published on the Site and occasionally changed.
a. Payments to Expert are dependent upon receipt of payment from specific Guests to whom Expert has provided service. To the extent to which a Guest does not pay for the services provided by you to the Guest including due to a refund or chargeback the portion of that payment due to you shall not be made or shall be deducted from future payments.
b. You further agree that all Payments are aggregated and processed through a third party and will be transferred to Expert only upon receipt from the third party processor.
c. MYPSYCHICADVICE
has adopted and implemented a policy that
payments and deduction from payments are made as described and specified on Expert Income Sources. It is hereby clarified that mypsychicadvice.com may, at its own discretion and at any time, change these payments methods and Host shall be entitled for payments according to the then new payments methods. For the avoidance of doubt it is hereby agreed that it is the Host's sole responsibility to be keep updated himself of on all of the Site's terms and conditions as well as all other billing and payment issues, as published on the Site and occasionally changed.
d. Host is free to check the mypsychicadvice.com records regarding the Host's performance and credits. MYPSYCHICADVICE has adopted and implemented a policy that only the mypsychicadvice.com records shall determine the credits and payments to which the Expert is entitled to receive. Mypsychicadvice.com shall not be obligated to present to Expert and/or any other third party any documents regarding charge backs or refunds made by Guests.
e. mypsychicadvice.com is entitled to deduct the sum of refunds and/or charge backs from the Host's payments and credits at any time and at its sole discretion. MYPSYCHICADVICE has adopted and implemented a policy that it is hereby clarified and agreed that only mypsychicadvice.com’s records shall determine the validity and the amounts of credits and payments, which the Expert is entitled to receive from mypsychicadvice.com. It is the Expert sole responsibility to check the mailing address details and/or bank account details and/or other account details, given to mypsychicadvice.com by Host, for the purpose of receiving payments from mypsychicadvice.com. It is hereby clarified that mypsychicadvice.com will not repay or transfer payments, nor will it be responsible for payments, in cases of wrong addresses or wrong account details.
f. For the avoidance of doubt it is hereby agreed that it is the Host's sole responsibility to be updated on all billing rates as well as all other billing and payment issues, as published and occasionally changed, on the Site.
g. THIRD PARTY PRODUCTS: You understand that products which may be made available or sold on the Site are not manufactured by mypsychicadvice.com but are manufactured by others. MYPSYCHICADVICE has adopted and implemented a policy that you understand and agree that you will use any such products only in compliance with any manufacturer's instructions for use accompanying such products. ANY WARRANTIES COVERING ANY SUCH PRODUCTS ARE PROVIDED SOLELY BY THE MANUFACTURER(S) OF SUCH PRODUCTS AND mypsychicadvice.com MAKES NO WARRANTY OF ANY KIND WITH RESPECT TO ANY SUCH PRODUCTS AND HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, DIRECT OR INDIRECT, INCLUDING, BUT NOT LIMITED TO, ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
h. Client or Member is obligated to report to mypsychicadvice.com in cases when he or she was billed directly by an Expert (i.e. not through mypsychicadvice.com).
UNDER NO CIRCUMSTANCES EXCHANGE OF CONTACT INFORMATION WITH CLIENTS IS PERMITTED. DOING SO IS THE SERIOUS VIOLATION OF OUR TERM OF USE AGREEMENT AND MAY LEAD TO SUSPENSION FROM THE SITE.
Time charges to Members are based on increments of a minute as measured on mypsychicadvice.com `s servers. Charges to Members are rounded up so that any part of a minute is considered a full minute of time charges. mypsychicadvice.com `s billing system is not fault-free or flexible; therefore mypsychicadvice.com shall not be liable for any problems, miscalculations or malfunctions in processing the payments owed by the Member. If the Member believes there is a mistake he or she may send his or her complaint to mypsychicadvice.com.
Additional Expert Representations and Warranties
By submitting the Expert registration form, you, the Expert, represent, warrant and agree to the following:
. You will not attempt to give service to minors in any way;
. MYPSYCHICADVICE has adopted and implemented a policy that you will not attempt to forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Mypsychicadvice Service;
. Under no circumstances you will attempt to text, upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements). Under no circumstances make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
. Under no circumstances you will attempt to interfere with or disrupt the services or servers or networks connected to the Mypsychicadvice! Services, including using any device, software or routine to bypass our robot exclusion headers; Under no circumstances you will attempt to intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
. You will not attempt to provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
. You will not attempt to collect or store personal data about members or clients in hard drive or any other form. Don’t store or print chat transcripts of sessions with members.
· MYPSYCHICADVICE has adopted and implemented a policy that at all times you, the Expert, will provide correct and accurate representation of skills, degrees, qualifications, background and other information as prompted by any form in Mypsychicadvice, and will maintain and update all such information during the term of this Agreement to keep it true, accurate, current and complete. In all circumstances you will maintain such skills, qualifications and other information, including maintaining your status in good standing as a licensed professional in any jurisdiction, as may be required by that jurisdiction. Under no circumstances you shall perform services or offer advice in any jurisdiction where you are not authorized or licensed or in legal standing to do so.

1 You will not attempt to provide any legal or medical advice or other advice or information which may only be lawfully rendered or provided by a licensed professional...
2 Under no circumstances you will attempt to provide offer or provide advice, directly or through writings, as to the value of securities or as to the advisability of investing in, purchasing or selling securities or any report or analysis concerning securities.
3 You will not attempt to provide offer advice or provide any product or services related to or claiming success with lottery numbers.
4 Under no circumstances you will attempt to misrepresent yourself or create a misleading name or listing. The aforementioned is an ongoing affirmative obligation for the Expert to maintain and update on a regular basis.
5 You will not attempt to provide give any sort of illegal or unlawful advice and use unlawful method with members, you are solely responsible for it and fully liable for all conduct.
Expert's Conduct:
MYPSYCHICADVICE has adopted and implemented a policy that you, the Expert, will be solely and fully liable for all conduct, services, advice, postings and transmissions that are made under your user name and password. You represent, warrant and declare that while you are using Mypsychicadvice.com as and Expert, you will act according to the following rules:
· MYPSYCHICADVICE has adopted and implemented a policy that Mypsychicadvice is not involved in any transactions between Expert and Members. Mypsychicadvice does not control the accuracy of any postings on the Site or transmissions through it by Members. In addition, Mypsychicadvice cannot and will not make any effort to verify the identify of any of its Members;
· Expert agrees that any information or content that Expert posts or transmits through Mypsychicadvice.com will not be considered Expert's confidential information, but rather this information, whether personal in nature or not, shall be owned by Mypsychicadvice. Expert further agrees and consents to the Expert's chats or transcripts, being captured in any format, controlled, processed and shared by Mypsychicadvice with third parties as designated solely by Mypsychicadvice;
· MYPSYCHICADVICE
has adopted and implemented a policy that
expert grants Mypsychicadvice an unlimited, irrevocable, royalty-free license to use, reproduce, display, edit, copy, transmit, process, control, publicly perform, and create derivative works communicate to the public or any third party any such information and content on a world-wide basis;
1 Under no circumstances provide any service that he or she is not qualified to provide, even if requested so by a Member. Expert will not answer questions in fields that are not within Expert's fields of expertise;
2 Under no circumstances mislead Members to believe that he or she can provide a service which is outside Expert's fields of expertise;
3 Don’t take any actions which may undermine, disrupt or manipulate the integrity of the Member feedback (rating) system on the Site.
Mypsychicadvice also reserves the right to exclude any rating without given explanation.
· Under no circumstances interfere with or disrupt the Mypsychicadvice.com site or servers or networks connected to the Site;
· Don’t attempt to gain unauthorized access to other computer systems or networks connected to the Site, and will not transmit "junk mail", or any unsolicited mass distribution of email or bulletin board postings;
· You further agree that you will not transmit any unlawful, harassing, libelous, privacy invading, abusive, threatening, defamatory, vulgar, obscene, racist, harmful, or otherwise objectionable material of any kind;
· Don’t disobey or breach this Agreement or any other applicable instructions conveyed by Mypsychicadvice or its officers;
· Don’t violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code;
· Under no circumstances upload, post, e-mail, transmit or otherwise make available: (a) any information or material that infringes a third party right, especially copyright or other intellectual property rights; (b) any third party advertisements, including banner exchange services; (c) software viruses, Trojan horses, worms or any other malicious application or (d) any information or material which may constitute or encourage conduct that is a criminal offense or civil wrong or otherwise violates any applicable law;
· Don’t impersonate any person or entity, or make any false statement regarding Expert's employment, agency or affiliation with any person or entity;
· Under no circumstances stalk, threaten or harass Members or other Experts or invade or attempt to invade their privacy;
· Don’t disclose any information that was provided to Expert by a Member and will use his or her best efforts to guard Member's privacy; and
· In all circumstances expert agrees to comply with all applicable laws regarding use of this Site. Expert may not use this Site to solicit the performance of any illegal activity or other activity which infringes the rights of Mypsychicadvice or others. Expert agrees not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any other person's use of the Site. Expert may not attempt to gain unauthorized access to any portion or feature of the Site by hacking, password "mining" or other illegitimate means.

Mypsychicadvice may, in its absolute discretion, remove or refuse to post or transmit any content uploaded by the Expert. Without derogating from the above, Mypsychicadvice may remove any content violating this Agreement. The Expert will bear all the risks associated with the uploading and transmitting material utilizing Mypsychicadvice.com, including reliance on its accuracy, reliability or legality
Member (client) agreement
By submitting the Member registration form, you, the Member, represent, warrant and agree to the following:
You are at least 18 years of age or a legally organized entity, that he or she is authorized to represent the person who is submitting a Member registration, and that he or she is authorized and allowed to sign the registration form on his or her behalf and bind him or her; The information furnished by you in the registration form is accurate, true and complete, and you will maintain and update such information during the term of this Agreement so that it will remain true, accurate, current and complete.
Member’s Conduct:
You, the Member, the client will be solely and fully liable for all conduct, postings and transmissions that are made under your user name and password. It is our policy that you warrant and declare that while you are using mypsychicadvice.com will act according to the following rules and agree to the following:
1. Member will have the sole responsibility to verify the Expert’s identity, qualifications, credentials, biographic information, licenses held, and other information delivered to Member by an Expert;
In addition, mypsychicadvice.com cannot and will not make any effort to verify the identity, qualifications, credentials, biographic information and any of information regarding any of the Experts;
2. Mypsychicadvice.com is not involved in any transactions between Member and Expert. Mypsychicadvice.com does not control the quality, relevance or accuracy of the advice, whether the Expert is qualified to provide the specific advice.
3. Member agrees that any information or content that he or she posts or transmits or receives through mypsychicadvice.com will not be considered confidential. Member grants mypsychicadvice.com an unlimited, irrevocable, royalty-free license to use, reproduce, display, edit, copy, transmit, publicly perform, create derivative works, or communicate to the public any such information and content on a world-wide basis.
Member consents to mypsychicadvice.com collecting and processing any personal information, as per the terms of mypsychicadvice.com’s Privacy Policy.
4. It is our policy that all interactions between Member and Expert will be billed through mypsychicadvice.com regardless if the interaction is online or offline. Member agrees to abide by the pricing terms agreed upon with an Expert while utilizing mypsychicadvice.com and to pay mypsychicadvice.com for all services rendered to Member by Experts;
5. Under no circumstances take any actions that may undermine, disrupt or manipulate the integrity of the Member feedback & rating system on the Site mypsychicadvice.com may change the minimum session fee at any time and without warning, and even remove old ratings posted for paid sessions. Mypsychicadvice.com also reserves the right to exclude without explanation any rating that Mypsychicadvice thinks may compromise the integrity of the member feedback system.
You further agree not to interfere with or disrupt the mypsychicadvice.com servers or networks connected to the Site;
Under no circumstances attempt to gain unauthorized access to other computer systems or networks connected to the Site, and will not transmit “junk mail”, “spam”, or any unsolicited mass distribution of email or bulletin board postings;
You further agree not to transmit through the Service any unlawful, harassing, libelous, privacy invading, abusive, threatening, defamatory, vulgar, obscene, racist, harmful, or otherwise objectionable material of any kind;
Don’t disobey or breach this Agreement or any other applicable instructions conveyed by mypsychicadvice.com;
You further agree not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code;
In all circumstances, don’t upload, post, e-mail, transmit or otherwise make available: any information or material that infringes upon a third party right, especially intellectual property rights; You further agree not to make available any third party advertisements, including banner exchange services; any software viruses, Trojan horses, worms or any other malicious application or any information or material which may constitute or encourage conduct that is a criminal offense or civil wrong or otherwise violates any applicable law;
You further agree not to impersonate and mimic any person or entity, or make any false statement regarding his or her employment, agency or affiliation with any person or entity or give false information to create any type of future disturbances or scam to defame site and experts;
In all circumstances don’t stalk, threaten or harass Experts or other Members or infringe upon or attempt to infringe upon their privacy; and;
MYPSYCHICADVICE has adopted and implemented a policy that in its absolute discretion, refuse to post, transmit or remove any content uploaded by the Member. Without derogating from the above, mypsychicadvice.com may remove any content violating this Agreement. The Member will bear all the risks associated with the uploading and transmitting of material while utilizing mypsychicadvice.com, including reliance on its accuracy, reliability or legality.
User Name and Password policy

2. In all circumstances host must immediately inform us of any apparent breach of security, such as loss, theft, or unauthorized disclosure or use of a username or password.
3. MYPSYCHICADVICE has adopted and implemented a policy that expert will remain personally liable for any unauthorized use of the Services.
4. When you, the Member, create and open an account with mypsychicadvice.com, you will be asked to provide a user name and password. MYPSYCHICADVICE has adopted and implemented a policy that you are entirely responsible for maintaining the confidentiality of your password and user name and any other security information related to your account.

APPROVALS AND
REQUIREMENTS
1. Mypsychicadvice.com’s prior permission and advance approval is required in order to act as a host. In all circumstances such approval is within the absolute discretion of mypsychicadvice.com.
2 You further agree that expert will be obligated to provide mypsychicadvice.com with any required document including legally identifying identification documents, which prove the Host’s age and a signed copy of this Agreement. MYPSYCHICADVICE has adopted and implemented a policy that in any case Expert fails to provide mypsychicadvice.com with requested documents; Expert faces immediate and permanent termination, cancellation and forfeiture of all credits from mypsychicadvice.com. Host hereby agrees that if Expert provides mypsychicadvice.com with false identification regarding his/her name and/or date of birth, You further agree that expert will not hold mypsychicadvice.com liable, under any circumstances, as Expert understands that this identification was accepted in good faith and to ensure that Expert is at least 18 years of age or age of majority in Host’s country. MYPSYCHICADVICE has adopted and implemented a policy that in the event that mypsychicadvice.com suspects or discovers that Host has provided false credentials or documents, Host's account will be frozen forthwith for further investigation and the Expert shall face permanent termination, cancellation and forfeiture of all credits from mypsychicadvice.com.
3. MYPSYCHICADVICE has adopted and implemented a policy that if mypsychicadvice.com requests to receive a signed copy of this Agreement Expert must oblige the same or the Expert shall face immediate and permanent termination, cancellation and forfeiture of all credits mypsychicadvice.com.
4. Termination of Account by Expert
MYPSYCHICADVICE has adopted and implemented a policy that expert may terminate their Agreement with Mypsychicadvice at any time by sending a signed notice to Mypsychicadvice via mail. E-mails will not be accepted. Mypsychicadvice shall invalidate Expert's user name and password within thirty (30) days of receiving such notice. Expert may inactivate his or her own account for any desired period of time from within their Mypsychicadvice account. Notwithstanding termination, all obligations of Expert under this Agreement relating to any activity prior to the termination date shall remain in full force and effect.
CERTAIN
OBLIGATIONS OF HOST
a. MYPSYCHICADVICE has adopted and implemented a policy that the Expert shall be subject to the Terms and Conditions of the Site. The Host shall not act in violation of those Terms of Use or cause or procure any other person to violate them. In addition to this Agreement and the Terms and Conditions of the Site, the Site includes additional terms and conditions that are published on specific pages on the Site, and shall also apply to Experts. MYPSYCHICADVICE has adopted and implemented a policy that additional terms and conditions may restrict or otherwise affect your rights in connection with the Site or the Communication Services. If any provision of these terms and conditions is held void or unenforceable to any extent, such provision shall be deemed excised and removed only to the extent to make the remaining provisions and these terms and conditions enforceable.
b. MYPSYCHICADVICE has adopted and implemented a policy that host shall not use the Communications Services or any of the other services, features and/or facilities available on or through the Site for any commercial purposes whatsoever, except as specified in this Agreement and to the extent they mutually benefit mypsychicadvice.com and the Host. MYPSYCHICADVICE has adopted and implemented a policy that expert may not use the Communications Services or any of the other services, features and/or facilities available on or through the Site to promote or act on behalf of any other person, entity or business on or off the internet.
c. You further agree that host shall not contact any Member of the Site for the purpose of supplying the Member with services outside the framework of the Communications Services thereby circumventing payment by the Member via mypsychicadvice.com payment system. MYPSYCHICADVICE has adopted and implemented a policy that host shall not solicit or encourage members to purchase services and/or features which may directly or indirectly compete with the Site or the Communications Services or the services provided by our Experts.
d. MYPSYCHICADVICE has adopted and implemented a policy that under no circumstances will you use or try to use the Communications Services in order to promote or procure any meetings or direct physical contact with any Members and/or any other third party.
e. MYPSYCHICADVICE has adopted and implemented a policy that host shall not transmit emails promoting mypsychicadvice.com or the Host's activities on mypsychicadvice.com other than emails sent via mypsychicadvice.com. Host agrees not to procure or encourage the transmission by any third party of emails promoting mypsychicadvice.com or the Host's activities on mypsychicadvice.com. MYPSYCHICADVICE has adopted and implemented a policy that if mypsychicadvice.com suspects that Expert is engaged directly or indirectly in such emailing activities, Host's account will be frozen immediately for further investigation and the Expert faces permanent termination, cancellation and forfeiture of all credits from mypsychicadvice.com.
HOST & MYPSYCHICADVICE
RELATIONS
1. Relationship between Expert and mypsychicadvice.com: mypsychicadvice.com is an independent contractor providing services to the Host. MYPSYCHICADVICE has adopted and implemented a policy that neither party is employed by the other party through a common-law employee/employer relationship or actual employee/employer relationship. Expert shall not present himself/herself as an employee or any other kind of representative mypsychicadvice.com.
2. Host must open all emails sent to Expert by mypsychicadvice.com in order to be updated regarding important items related to the Communications and Advertising Services. MYPSYCHICADVICE has adopted and implemented a policy that expert must regularly check Host's Expert page in order to be updated regarding important items related to the Communications and Advertising Services.
3. Mypsychicadvice.com will be entitled to perform occasional monitoring, at its own discretion, of the activities of the Experts via the Communications Services. MYPSYCHICADVICE has adopted and implemented a policy that allows mypsychicadvice.com, inter alias, to analyze and develop methods for improving services to all of its Experts and Members
